Blackmail<\/h1>\n<\/div><\/div>\n\n\n\n


<\/p>\n\n\n\n

Blackmail is defined by Article 312-10 of the French Criminal Code<\/a> as \u201cthe act of obtaining, by threatening to reveal or allege facts likely to damage a person\u2019s honour or reputation, either a signature, commitment or waiver, the disclosure of a secret, or the handing over of funds, valuables or property of any kind<\/em>\u201d.<\/p>\n\n\n\n

Blackmail is punishable by 5 years\u2019 imprisonment and a fine of \u20ac75,000.<\/p>\n\n\n\n

  1. The material element of the offence of blackmail<\/strong><\/li>\n<\/ol>\n\n\n\n

    A threat\u2026<\/span><\/p>\n\n\n\n

    The threat may be made in writing or verbally and may be addressed to the victim or to a third party.<\/p>\n\n\n\n

    The threat must be unambiguous and sufficiently precise: there must be no doubt in the victim\u2019s mind that the perpetrator is threatening them.<\/p>\n\n\n\n

    \u2026to reveal or allege facts likely to damage a person\u2019s honour or reputation\u2026<\/span><\/p>\n\n\n\n

    It does not matter whether the facts are true or false: it is sufficient that they are likely to damage the person\u2019s honour or reputation.<\/p>\n\n\n\n

    Damage to honour or reputation is assessed in light of the victim\u2019s specific circumstances.<\/p>\n\n\n\n
