Abuse of Vulnerability<\/h1>\n<\/div><\/div>\n\n\n\n

<\/p>\n\n\n\n


Abuse of vulnerability, as its name suggests, consists of taking advantage of a person by exploiting their lack of knowledge or their physical or mental vulnerability.<\/p>\n\n\n\n

This offence is provided for and punishable under Articles 223-15-2 et seq. of the French Criminal Code<\/a>.<\/p>\n\n\n\n

    \n
  1. The prerequisites for abuse of vulnerability<\/strong><\/li>\n<\/ol>\n\n\n\n

    For the offence of abuse of vulnerability to be established, the following conditions must be met:<\/p>\n\n\n\n

    i) A particularly vulnerable person<\/span><\/p>\n\n\n\n

    The victim must be in a situation of particular vulnerability. This may be due to their age, but also to illness, disability, physical or psychological impairment, or pregnancy. <\/p>\n\n\n\n

    ii) A state of ignorance or vulnerability<\/span><\/p>\n\n\n\n

    This state implies that the victim is unable to resist the perpetrator\u2019s demands. <\/p>\n\n\n\n

    This may result from significant emotional isolation, visual or hearing impairments affecting the person\u2019s ability to exercise independent judgment, recent bereavements, etc. <\/p>\n\n\n\n

    Merely being elderly, for example, is not sufficient: it must be demonstrated that the person was in a state of ignorance or vulnerability as a result of their age at the time of the events.  <\/p>\n\n\n\n

      \n
    1. <\/strong>The material element of abuse of vulnerability<\/strong><\/li>\n<\/ol>\n\n\n\n

      Exploiting the person\u2019s vulnerability in order to induce them to act<\/span><\/p>\n\n\n\n

      The perpetrator must exploit the person\u2019s state of ignorance or vulnerability in order to induce them to act. This is frequently characterised by serious and\/or repeated pressure resulting in a state of psychological subjection. <\/p>\n\n\n\n

      An act or omission likely to cause serious harm<\/span><\/p>\n\n\n\n

      The exploitation of the person\u2019s state of ignorance or vulnerability must have led them to perform an act or refrain from acting.  <\/p>\n\n\n\n

      The act that the vulnerable person is induced to perform may be either material or legal in nature. <\/p>\n\n\n\n

      Examples of acts likely to cause serious harm include: disposing of assets by will in favour of the person who induced them to do so, handing over cheques or cash, taking out loans, selling a car, engaging in sexual relations, changing a beneficiary clause, or taking out a life insurance policy, etc. <\/p>\n\n\n\n

        \n
      1. <\/strong>The intentional element of abuse of vulnerability<\/strong><\/li>\n<\/ol>\n\n\n\n

        Awareness of the victim\u2019s vulnerability<\/span><\/p>\n\n\n\n

        For the offence to be established, the perpetrator must have been aware of the victim\u2019s vulnerability at the time the acts were committed. <\/p>\n\n\n\n

        Intent to exploit the victim\u2019s state of vulnerability<\/span><\/p>\n\n\n\n

        The perpetrator must also have intended to exploit the victim\u2019s state of vulnerability. <\/p>\n\n\n\n

        This condition may be inferred from the steps taken by the perpetrator to obtain the acts in question while being aware of the victim\u2019s vulnerability. <\/p>\n\n\n\n


        Penalties<\/span><\/p>\n\n\n\n

        Where these conditions are met, the perpetrator is liable to 3 years\u2019 imprisonment, a fine of \u20ac375,000 and additional penalties (for example, a prohibition from carrying out the professional or social activity in the course of which, or in connection with which, the offence was committed, for a maximum period of five years).<\/p>\n\n\n\n

        Aggravating Circumstances<\/span><\/p>\n\n\n\n

        Where the offence is committed by the leader of a group whose activities have the purpose or effect of creating, maintaining or exploiting the psychological or physical subjection of persons participating in those activities, the penalties are increased to 5 years\u2019 imprisonment and a fine of \u20ac750,000.<\/p>\n\n\n\n

        Where the offence is committed by an organised criminal group whose members belong to a group whose activities have the purpose or effect of creating, maintaining or exploiting the psychological or physical subjection of persons participating in those activities, the penalties are increased to 7 years\u2019 imprisonment and a fine of \u20ac1 million.<\/p>\n\n\n\n
