Abuse of vulnerability, as its name suggests, consists of taking advantage of a person by exploiting their lack of knowledge or their physical or mental vulnerability.

This offence is provided for and punishable under Articles 223-15-2 et seq. of the French Criminal Code.

1. The prerequisites for abuse of vulnerability

For the offence of abuse of vulnerability to be established, the following conditions must be met:

i) A particularly vulnerable person

The victim must be in a situation of particular vulnerability. This may be due to their age, but also to illness, disability, physical or psychological impairment, or pregnancy. 

ii) A state of ignorance or vulnerability

This state implies that the victim is unable to resist the perpetrator’s demands. 

This may result from significant emotional isolation, visual or hearing impairments affecting the person’s ability to exercise independent judgment, recent bereavements, etc. 

Merely being elderly, for example, is not sufficient: it must be demonstrated that the person was in a state of ignorance or vulnerability as a result of their age at the time of the events.  

2. The material element of abuse of vulnerability

Exploiting the person’s vulnerability in order to induce them to act

The perpetrator must exploit the person’s state of ignorance or vulnerability in order to induce them to act. This is frequently characterised by serious and/or repeated pressure resulting in a state of psychological subjection. 

An act or omission likely to cause serious harm

The exploitation of the person’s state of ignorance or vulnerability must have led them to perform an act or refrain from acting.  

The act that the vulnerable person is induced to perform may be either material or legal in nature. 

Examples of acts likely to cause serious harm include: disposing of assets by will in favour of the person who induced them to do so, handing over cheques or cash, taking out loans, selling a car, engaging in sexual relations, changing a beneficiary clause, or taking out a life insurance policy, etc. 

3. The intentional element of abuse of vulnerability

Awareness of the victim’s vulnerability

For the offence to be established, the perpetrator must have been aware of the victim’s vulnerability at the time the acts were committed. 

Intent to exploit the victim’s state of vulnerability

The perpetrator must also have intended to exploit the victim’s state of vulnerability. 

This condition may be inferred from the steps taken by the perpetrator to obtain the acts in question while being aware of the victim’s vulnerability. 

Penalties

Where these conditions are met, the perpetrator is liable to 3 years’ imprisonment, a fine of €375,000 and additional penalties (for example, a prohibition from carrying out the professional or social activity in the course of which, or in connection with which, the offence was committed, for a maximum period of five years).

Aggravating Circumstances

Where the offence is committed by the leader of a group whose activities have the purpose or effect of creating, maintaining or exploiting the psychological or physical subjection of persons participating in those activities, the penalties are increased to 5 years’ imprisonment and a fine of €750,000.

Where the offence is committed by an organised criminal group whose members belong to a group whose activities have the purpose or effect of creating, maintaining or exploiting the psychological or physical subjection of persons participating in those activities, the penalties are increased to 7 years’ imprisonment and a fine of €1 million.
